Buyer Terms
Version 1.4 · registry edition 2 · in effect from 2026-10-03
Buyer terms
These terms govern buying at Bid Boss. They are a binding contract between you and Bid Boss Inc. They apply when you register, and each time you place a bid on a Bid Boss lot, however and wherever that bid is placed, whether through the platform where our auctions are hosted today or through any of the Services, now or in the future.
1. Who we are, who you are, and how these terms bind
1.1 Bid Boss, we, us, our mean Bid Boss Inc., Unit 4, 12 Vulcan St, Etobicoke, Ontario M9W 1L2. You and Buyer mean the person or business registered to bid or buying a Lot.
1.2 You accept these terms when you register an account, and you accept the version then in effect each time you place a Bid. Placing a Bid on a Bid Boss Lot, however placed, is acceptance of these terms for that purchase.
1.3 Where our auctions are hosted on a third-party bidding platform, that platform's terms govern your use of its website. For the purchase of any Bid Boss Lot, these terms, our fee schedule, our grading standard and our claims policy govern, and they prevail over any conflicting term of the hosting platform to the fullest extent permitted. These terms are written to continue unchanged if bidding moves to the Services.
1.4 Each acceptance is affirmative and is recorded with the document version, date and time, and IP address. The recorded version you accepted governs each purchase, and the per-sale auction terms, frozen at listing, form part of these terms for that sale. Electronic acceptance is binding under Ontario's Electronic Commerce Act, 2000.
1.5 You must be at least 18 years old and able to enter binding contracts, and you confirm this at registration.
2. Definitions
2.1 Auction: a Bid Boss online timed auction with no reserve. Lot: an item or grouped set offered as one unit. Bid: your offer to buy a Lot at a stated amount. Hammer Price: the winning Bid at close. Buyer Premium: the percentage in section 5. Handling Fee: the per-Lot fee in section 5. All-in Price: Hammer Price plus Buyer Premium plus Handling Fee plus applicable tax. Wallet and Bid Boss Dollars and BBD: store credit under the Bid Boss Dollars terms, one BBD equal to one Canadian dollar. Grade: the condition rating in section 8. Condition card: the system-generated inspection summary shown on a listing. Consumer: an individual buying for personal, family or household purposes. Business Buyer: anyone buying for business or resale purposes. Verified Reseller: a Business Buyer whose business name and tax registration number, a Canadian business number or, for a United States business, an EIN or state sales-tax permit, we have verified, shown as verified in the account. Pickup Deadline: Saturday at 3:00 PM following the Auction close.
2.2 All amounts are in Canadian dollars. Headings are for convenience only, and "including" means including without limitation.
2.3 Only the listing describes a Lot: the Grade, the photographs, the condition card and the listing text. Statements outside the listing, including verbal statements at pickup or in support, form no part of the description, and no one is authorized to vary these terms except in a writing signed by Bid Boss.
3. Accounts, and our express rights
3.1 Registration is open: anyone meeting section 1.5 may create an account. One account per person or business. Registration information must be true, complete and current. You are responsible for activity under your account and for keeping your sign-in credentials secure, whether you sign in with a password or with one-time codes, including the email account and phone number that receive them.
3.2 We may, acting reasonably and where the law allows: decline or refuse a registration; suspend, restrict or close an account; cancel or void any Bid, Lot or sale affected by error, technical fault, or suspected fraud, manipulation or abuse; hold a payment, a release of goods, or a payout pending identity or payment verification; and refuse service. Where we rely on this section we will tell you what action we took and, where we reasonably can, the reason.
3.3 Where verification is required before money moves, we verify identity through a third-party provider. We keep only the result and a reference, never your identity documents. Our privacy policy explains this.
3.4 Closing an account does not cancel amounts owed and does not remove purchased Wallet value, which stays governed by the Bid Boss Dollars terms.
4. The auction
4.1 Every Auction is no reserve. There is no minimum price and the highest Bid at close wins.
4.2 Lots close on a soft-close basis, so a late Bid can extend a Lot's closing time. The platform controls the exact close mechanics.
4.3 A Bid is binding. A Bid is an irrevocable offer to buy the Lot at that amount plus the Buyer Premium, Handling Fee and applicable tax. A binding contract of sale forms at the close of the Lot between you and Bid Boss, or, for consigned goods, between you and the consignor with Bid Boss acting as the disclosed sales agent, liable as agent only and not as seller, while your claims path under section 9 runs with us on every Lot and we administer any remedy for the consignor. You cannot withdraw a winning Bid.
4.4 You are responsible for your Bids, including Bids placed in error. Review each Bid before you confirm it.
4.5 Once a no-reserve Lot has received its first Bid it will be sold, except that we may withdraw a Lot at any time where required for legal or safety compliance, including a recall, a prohibited item, or a title problem, and we may correct an obvious listing error or cancel and re-run an Auction or Lot affected by a technical fault, with our responsibility limited to refunding amounts you paid for the affected Lot.
4.6 No consignor, seller, or anyone acting for them may bid on their own goods, directly, indirectly, or through another person.
5. Prices, fees and tax
5.1 The total you pay for a Lot is the All-in Price: the Hammer Price, plus a Buyer Premium of 15 percent of the Hammer Price, plus a Handling Fee of $1.50 per Lot, or $10 for a pallet Lot, plus applicable tax.
5.2 We show you the All-in Price, or the exact fees and tax that make it up, before you place a Bid. The Buyer Premium and Handling Fee are mandatory and apply to every Lot.
5.3 The Handling Fee is not refundable in any circumstance, including where a Lot is refunded, except where a refund of fees is required by law.
5.4 Tax is charged by how you take delivery: (a) collection at our premises is a delivery in Ontario, so Ontario HST applies whatever province you live in; (b) shipment within Canada takes the tax of the destination province; (c) Lots shipped to US addresses are exported; no GST/HST is charged. US duties or taxes may apply on import.
5.5 Adding funds to your Wallet is not taxed. Tax is charged when you pay for a Lot.
6. Payment
6.1 Payment is due in full within forty-eight (48) hours of auction close. For eligible customers, the card on file may be automatically charged after close unless another payment method was requested at registration. Accepted methods: Visa, Mastercard, American Express, debit, Interac e-Transfer, and cash at pickup.
6.2 If an invoice is still unpaid after the 48 hours we will issue a warning and set a final deadline of the Saturday following the Auction. If that deadline passes unpaid, the order is cancelled into section 10, and the restocking fee in section 7 applies.
6.3 If you dispute a charge for a lot you received as described, we may recover the dispute fees we are charged and suspend your account. This does not apply to disputes you are entitled to make by law.
7. Cancellation by you, and the restocking fee
7.1 A Bid is binding, so a cancellation you initiate after your invoice is created is a default. Where a return or cancellation is approved for a reason other than our error, a restocking fee applies equal to the greater of $25.00 or fifteen percent (15%) of the lot price, plus the handling fee and any preparation or shipping costs already incurred. No restocking fee is charged where the error is ours, the item is wrong, or a claim is upheld. A second offence results in permanent suspension of bidding privileges. This fee is a genuine pre-estimate of our costs of cancellation and relisting, not a penalty.
7.2 The restocking fee is never charged where the cancellation results from our error, a wrong item, or a claim we uphold.
7.3 A second cancellation results in a permanent bar from bidding and participation.
7.4 We may collect the restocking fee from your Wallet balance, and any unpaid amount remains a debt.
8. Condition, grades and how we describe Lots
8.1 Everything sold at Bid Boss is used, returned, overstock or liquidation stock, sold as received, meaning in the condition it is in at sale.
8.2 We inspect every Lot and assign it a Grade. The Grade, the photos and the condition card together are our description of the Lot. The Grade is computed by our system from what the inspection observed.
8.3 The grades:
| Grade | What it means | What you can expect |
|---|---|---|
| New / Overstock | Factory sealed. The tape test: a single tape on both sides, never opened. Cosmetic damage to the box never changes this grade. | Never been opened. Straight from the source. |
| A | Open box, no signs of use, complete. | Opened, not used. As good as new. |
| B | Light use, cosmetically sound, complete. | Used lightly, everything present, works as it should. |
| C | Heavy use; or medium use with missing components or functionally relevant accessories; or missing components with the item still working. | Shows real use, still works, priced to reflect it. |
| D | Fails the functional test, or determined non-working. | Does not power on. For parts, repair, or projects. |
8.4 The following rules form part of the description standard: a missing user manual never changes the Grade; a missing generic accessory never changes the Grade unless the item needs it to work; box damage never downgrades a factory-sealed item; missing components are named, never hidden; we state how deeply we tested, full, limited, or packaging-judged, and never present a limited test as a full one; where a product family has similar models, the model number is read from the item and confirmed before listing.
8.5 When you bid, you buy the Lot at its stated Grade and disclosed condition. A Lot that matches its Grade and disclosures is as described, even if it shows the wear its Grade signals. You bid from photos, the condition card and the description, so review them, and direct questions to our online support before bidding.
8.6 Nothing in this section removes rights you have by law. Section 9 explains claims.
9. Claims
9.1 Claims must be submitted in writing within the window to support@bidbossinc.ca, with your invoice number, lot number and photos. Once your Bid Boss account is open, claims are filed from your invoice in your account.
9.2 New / Overstock, Grade A and Grade B items carry a claim window for major functional defects of twenty-four (24) hours from pickup or confirmed delivery, seven (7) days for accounts verified as resellers, and fourteen (14) days only under a signed reseller addendum. Grade C and Grade D items are final sale as to condition. Regardless of grade, an item that is the wrong item or materially misdescribed is always reviewable. An item is also always reviewable if a critical accessory needed for it to function was missing and the listing did not disclose it.
9.3 Claims are made with your invoice or lot number and evidence, usually photographs. If we accept a claim we resolve it by a replacement where one exists, or another remedy we agree. An upheld claim is refunded to your original payment method. The Handling Fee is not refundable except where the law requires it. A ticket is a support request about your account, payment, pickup or shipping, handled through online support. A claim is a formal request about a Lot that does not match its grade or description, submitted under 9.1 within the claim window. Only a claim produces a refund decision, and a ticket never starts, extends, or replaces a claim window.
9.4 The claim window is the window for our fast-track claims process. It sits on top of the rights the law gives you and does not limit them. A Consumer keeps the rights, and the time to enforce them, that Ontario law provides, whatever these windows say. A Business Buyer is bound by the windows in 9.2 as a condition of any claim.
9.5 Verified Reseller window. Verification of your business name and tax registration number establishes your account as a business accepting commercial terms and unlocks the 7-day window, which applies as a commercial term and as a condition of any claim. A window longer than 7 days, to a maximum of 14 days, applies only where set out in an individual written reseller agreement with us; no longer window applies by default. Reseller status may be withdrawn where verification fails or the account is misused, and the window for each Lot is the one that applied to your account at its sale.
10. Collection, shipping, and the abandonment ladder
10.1 After you win, you choose pickup or shipping for your order. You can switch between pickup and shipping until your items are released or shipped, by emailing support@bidbossinc.ca. A switch from pickup to shipping is free at any time before the Pickup Deadline. A switch from shipping to pickup is available until your order is dispatched: it is free before packing of your order has begun, and once packing has begun it carries a shipping-cancellation fee of the greater of $20 or 15 percent of the shipping charge, a genuine pre-estimate of the packing labour and materials then incurred, never charged where the switch results from our error, and chargeable to your order or set off against your Wallet.
10.2 Pickup. Pickup is by appointment only, booked after the auction, at Unit 4, 12 Vulcan Street, Etobicoke, ON M9W 1L2 (Thursday and Friday 12:00 PM to 5:00 PM, Saturday 12:00 PM to 3:00 PM). Government-issued photo ID and a signature are required before release. A person collecting for you must be authorized by you in writing in advance. No partial pickup: you collect your whole order or the uncollected part enters the ladder in 10.5. The Pickup Deadline is Saturday 3:00 PM. If no pickup slot is available before the Pickup Deadline, switch to shipping at no charge or request an arrangement, and slot unavailability is never treated as abandonment. Risk in a Lot you collect passes to you on release at the counter, to you or the person you authorized.
10.3 Shipping. After the auction, request shipping and you will receive a quote. Nothing dispatches until you approve it, and shipping is paid before release. We combine Lots into fewer parcels where practical; consolidation is best effort and not guaranteed. A signature is required on delivery. Risk of loss passes to you when your order is released to you at the counter or handed to the carrier, whichever occurs first. Damage or loss in transit is pursued through the carrier's claims process; Bid Boss helps you file the claim and supports it. Refusing or failing to accept a shipment is not a return.
10.4 The shipping policy carries the full shipping and pickup detail and forms part of these terms.
10.5 Abandonment. All items must be picked up, or shipping requested, by Saturday at 3:00 PM following the auction. If an item is not collected and no shipping has been requested by then, we will notify you by email and text message, and you will have seven (7) more days to collect it or request shipping. A storage fee of $5.00 per lot per day applies from the Saturday deadline, and you authorize us to charge it to your card on file. An item still not collected or requested seven (7) days after that notice is deemed abandoned, and you authorize us to resell it on your behalf. Your original purchase is not cancelled or refunded. From the resale proceeds we deduct the storage fees, an abandonment fee equal to the greater of $25.00 or twenty-five percent (25%) of your original lot price, and the costs of resale; any remaining balance is held for you and paid on written request. Two abandoned purchases result in permanent suspension of bidding privileges.
11. Our responsibility to you
11.1 Bid Boss stands behind each disclosed Grade and condition, and section 9 governs the remedy where a Lot does not match them.
11.2 To the extent the law allows: our total liability for any Lot, and for anything connected with it, is limited to the amounts you paid for that Lot; our total liability otherwise arising under these terms is limited to the amounts you paid us in the twelve months before the claim arose; and we are not liable for indirect or consequential loss, for loss of profit, revenue, business, opportunity, goodwill or data, or for loss arising from your delay in collecting, inspecting or claiming.
11.3 Nothing in these terms removes or limits any right, condition or warranty the law does not allow us to remove or limit, including the implied conditions that apply to a sale to a Consumer. Where a term conflicts with such a right, the right prevails and the rest of these terms continue.
11.4 Claims under or in connection with these terms lie against Bid Boss Inc. only. No director, officer, employee, or shareholder of Bid Boss Inc. has any personal liability under these terms, and those individuals may rely on this clause.
11.5 Everything sold is used, returned, overstock or liquidation stock, and you accept the risks inherent in goods of that kind. You are responsible for how a Lot is used after release. Inspect it, and where it is electrical, mechanical or safety-relevant, have it checked by a qualified person before use. You are responsible for your own installation, modification, repair and resale, and you will compensate us for third-party claims arising from your use or resale of a Lot, except to the extent caused by our breach of these terms. Nothing in this clause limits your rights under sections 8 and 9 for a Lot that did not match its description.
11.6 Help loading at pickup is a courtesy, provided at your risk except where we are negligent.
12. Conduct
12.1 You must not misuse the platform or an Auction, place Bids you cannot pay, bid or arrange bidding on goods you consigned, use automation to bid except as an accessibility accommodation, interfere with other bidders, or use Bid Boss for an unlawful purpose. The acceptable use policy forms part of these terms.
12.2 Where a Lot's listing states a resale restriction, such as no export or a stated channel limitation, that restriction is a term of your purchase of that Lot and binds you and anyone you resell to with notice of it.
13. Governing law and disputes
13.1 These terms are governed by the laws of Ontario and the laws of Canada applicable there.
13.2 Contact us first through online support; most issues resolve there. Support is provided through our online channels, not by telephone.
13.3 If you are a Consumer, nothing in these terms takes away your right to bring a claim in an Ontario court, including Small Claims Court, or your right to take part in a class proceeding where the law gives you that right. We do not require Consumers to arbitrate.
14. Changes
14.1 We may change these terms. The current version and effective date are shown here. A material change binds you when you accept it, which we ask before your next Bid, and every version and acceptance is recorded.
15. Final provisions
15.1 Neither party is responsible for delay or failure caused by events beyond reasonable control, including carrier failures, platform outages and emergencies. Obligations pause for the duration, and we may extend affected deadlines, including pickup windows, accordingly. This clause never reduces a Consumer's non-waivable rights.
15.2 You may not assign your account or these terms. We may assign to an affiliate or a successor to the business.
15.3 Terms that by their nature continue, including amounts owed, open claims, liability limits, and sections 11 and 13, survive the closure of your account.
15.4 If any part of these terms is unenforceable, the rest continue in force. Our delay or failure to enforce a term is not a waiver of it. These terms, together with the documents they incorporate, are the entire agreement between you and us for buying at Bid Boss and replace every prior statement, subject always to rights the law does not permit to be limited.
